Terms and Conditions
The terms and conditions contained in the rental agreements between WILLIAMS SOLUTIONS UNIPESSOAL LDA and the customer are intended to define rules of use, rights, and responsibilities for both the customer and the company, ensuring transparency and protecting both parties from potential legal problems.
TERMS OF USE
The customer must be an authorized driver aged between 23 and 65 years old and have held a driver’s license for more than 5 years (from the date of the first license). The customer may not use the car to transport goods or tow any other vehicle.
CONDITION OF THE CAR AND RETURN
If the vehicle is returned more than 30 minutes late, the lessor shall charge compensation equivalent to one day’s rental. There will be no refund of the rental contract amount when the customer returns the vehicle earlier than contracted.
CUSTOMER/DRIVER RESPONSIBILITIES:
-Loss of documents and keys + vehicle downtime cost
-Fuel replacement + management fee
-Damage or holes in upholstery due to cigarettes (interior) + vehicle downtime cost
-Undercarriage damage (driving on inappropriate roads) + cost of vehicle immobilization
-Tire cut (sidewall)
-Cleaning fee (unacceptable vehicle interior)
-Negligence (e.g., driving under the influence of alcohol or drugs) + cost of vehicle immobilization
-The car must be returned with the same amount of fuel as it received. Otherwise, it will be charged according to the principle of proportionality, which shall not exceed the average costs incurred by the lessor for refueling the vehicle. The average is calculated taking into account the costs related to the allocation of human resources and the movement of the vehicle to refuel.
-Fines, violations, and towing for violations or non-payment of parking fees. Towing fees must be paid directly by the customer at the police station, and the rental company will not provide a replacement vehicle or assist in resolving a vehicle immobilization issue. Every day, all rentals made by the company and the respective driver information will be sent to the PSP (Madeira Island Police). They have all the information they need to issue fines to customers or take any other action to block the vehicle.
DEPOSITS AND COVERAGE
The rental company will not request a deposit if you choose to rent the car with fully comprehensive insurance directly from the supplier (‘SCDW’).
However, if you request the car without comprehensive insurance (‘SCDW’), with a deposit/security deposit/excess, this will be returned at the end of the rental period, provided that the rental conditions are met.
There are 3 options:
– ‘CDW’: ‘Collision Damage Waiver’ applies if the car is returned with damage, with the customer liable for up to €400 (Group A, B, B+, C, C+, D), €800 (Group D+, E) and €1600 (Group F).
– ‘ER-CDW’: ‘Excess Reduction’ is a supplement that reduces the excess liability to €200 (Groups A, B, B+, C, C+, D), €400 (Groups D+, E) and €800 (Group F).
– ‘SCDW’: ‘Super Collision Damage Waiver’ is a supplement that eliminates the excess liability for the car, bodywork, windows, rims, and tires (punctures only). This product is purchased directly from the rental company.
Advantages of comprehensive insurance: You do not need to deal with excess reimbursement systems or third-party insurance where you have to request reimbursement of the amount paid to the rental company (e.g., credit card insurance or insurance with agencies or operators).
However, ‘SCDW’ protection does not cover:
-Loss of documents and keys + vehicle immobilization cost
-Fuel replacement + management fee
-Damage or holes in upholstery due to cigarettes (interior) + vehicle immobilization cost
-Undercarriage damage (driving on inappropriate roads) + vehicle immobilization cost
-Sidewall cuts (driving on and off curbs) + administration fee
Punctures are covered on tires.
-Cleaning fee (unacceptable vehicle interior)
-Other negligence (e.g., driving under the influence of alcohol or drugs) + vehicle immobilization costs, etc.
METHODS OF PAYMENT FOR DEPOSITS / DEDUCTIBLES
If you rent the vehicle with the ‘CDW’ option: ‘Collision Damage Waiver’, all credit cards are accepted (except AMERICAN EXPRESS);
If you rent the vehicle with the ‘Excess reduction’ option, cash deposits are accepted and you do not need a credit card to rent a car;
If you rent the vehicle with the ‘SCDW’ option, no deposit is required and you do not need a credit card to rent a car.
INCLUDED IN THE RENTAL:
-Emergency/Roadside Assistance – All rentals include 24-hour roadside assistance for breakdowns or accidents, except for fuel replacement and off-road assistance (off paved roads). This service provides vehicle towing to the repair shop and transportation of occupants (TAXI / TVDE) to the nearest rental station, accommodation, or airport;
-Tolls, not applicable to Madeira Island, as there are no tolls;
-Kilometers (unlimited);
-Fuel policy: Return as delivered;
-1 additional driver included
-Rentals at the office, company parking lots, airport, or hotels/accommodations near the company’s area of operation (up to 10 km from the airport/offices). If you request the vehicle to be rented at hotels/accommodations, a shuttle will be provided to the office in Funchal or the airport, whichever is closer. You must also return the vehicle to the same place where it was delivered.
NOT INCLUDED IN THE RENTAL:
-Fines, violations, and towing for violations or non-payment of parking fees
All rentals made by the company and the respective driver information will be sent to the PSP (Madeira Island Police). They have all the information needed to issue fines to customers. Towing fees must be paid directly by the customer at the police station and the rental company will not provide a replacement vehicle or assist in resolving a vehicle immobilization issue.
– Fee for ‘Out of Zone’ rentals
Rentals outside the center of Funchal and outside the Santa Cruz/Airport area
– Fee for ‘Outside Zone’ rentals
Rentals outside working hours (8:01 p.m. – 8:29 a.m.) and returns outside working hours (8:01 p.m. – 8:29 a.m.).
If you need the car to be available outside normal business hours, the car rental company will arrange for a team member to be available, or you can choose the KeyBox system (box with keys and parking access card).
Advance notice is required for this service and an additional fee may apply (employee service).
– Cleaning fee
The rental company will charge a cleaning fee if more thorough cleaning is required at the end of the rental period.

ACCIDENTS, BREAKDOWNS, AND REPLACEMENT VEHICLES
Customers must report all accidents or thefts in which they are involved. An accident report must be completed with the details of the driver and the third party involved, and their respective telephone numbers. Customers must request the presence of the police, as they are the official authority for preparing accident reports. In the event of accidents caused by falling rocks on the road or poor road conditions (potholes), the presence of the police must be requested in order to prepare an official report.
In the event of an accident or mechanical breakdown, and if the vehicle is not in a condition to drive, the lessor must provide the lessee with a replacement vehicle. If the accident or mechanical breakdown (negligence) is the fault of the lessee, they will not be entitled to a replacement vehicle or a refund for the remaining days. A mechanical breakdown caused by changing fuel or misuse of the clutch, where a burning smell arises due to excessive starting, is a strong indicator that the starter motor is overheating due to continuous use of the clutch. Driving or resting your foot on the clutch is harmful to the system, as it causes premature wear and overheating. The clutch is only used to change gears or stop the vehicle. These are examples of misuse by the customer.
RENTAL PAYMENT METHODS
-All credit or debit cards except AMERICAN EXPESS (on arrival)
-Cash (on arrival)
-Bank transfer (more than 3 working days before picking up the vehicle)
The customer can choose to rent the vehicle during or outside business hours using the keybox system (box with keys and parking lot entry/exit card). This gives you greater freedom to pick up the car at Parking Lot P6 at any time, avoiding waiting times (employee assistance).
FLIGHT ARRIVAL NUMBER AND TELEPHONE CONTACT
This can be very useful for monitoring your flight before departure. Even if your flight is delayed, we will be waiting and will guarantee your reservation. You must provide us with your telephone number and flight number. Otherwise, reservations will not be valid or confirmed. If you are already staying in Madeira and request the car at the airport a day or days later, you must enter your flight number and telephone number so that we can contact you or track your flight online. This allows us to anticipate any problems that may arise when picking up the car (flight problems, delays, diversions).
DIVERGED FLIGHTS
Given that weather conditions at Madeira airport are sometimes unfavorable, we can deliver the car to the marina area in Funchal. If your flight is diverted to the island of Porto Santo, you can opt for the ferry (Porto Santo – Funchal). You can inform us by email/call/text message.
ONLINE RESERVATION REFUNDS
Up to 3 days before the start of the rental, a cancellation fee of €10 (VAT included) will be charged to cover bank transfer expenses (refund of the amount paid by bank transfer).
Less than 3 days before the start of the rental, the equivalent of 1 day’s rental will be charged, ‘1 day’s rental rate’, available online at the time of cancellation + €10 cancellation fee (VAT included) to cover bank transfer expenses.
REFUNDS FOR INSUFFICIENT DOCUMENTATIONIn case of insufficient documentation (valid driver’s license or passport), failure to provide a valid credit card, unable to guarantee the deposit/excess/security deposit (CDW and EX-CDW Insurance Option), the equivalent of 1 day’s rental will be charged. The ‘1 day rental rate applied’ will be the rate available online at the time of cancellation + a cancellation fee of €10 (VAT included) to cover bank transfer fees.REFUNDS FOR ONLINE RESERVATION CHANGES
If the change involves a reduction in the number of days, there will be no refund.
IMPORTANT NOTICE
WILLIAMS SOLUTIONS UNIPESSOAL LDA, WILL NOT BE LIABLE TO THE CUSTOMER, ANY AUTHORIZED DRIVER OR PASSENGER FOR THE LOSS OR DAMAGE TO PERSONAL BELONGINGS LEFT IN THE CAR, EITHER DURING THE TERM OF THIS AGREEMENT OR AFTER ITS TERMINATION.
